TERRELL, Justice. March 28, 1950, petitioner was tried by the Judge without a jury, in the Criminal Court of Record, Dade County, on a charge of armed robbery. He was convicted and sentenced to serve a term of five years in the state penitentiary. Motion for a new trial was denied and appeal was taken to this Court where the judgment of the trial court was affirmed April 6, 1951, 53 So.2d 326.
