Frederick D. Woods was convicted of murder made capital because it was committed during the course of a robbery. Ala. Code 1975, Â§ 13A-5-40(a)(2). The jury, by a vote of 10-2, recommended that Woods be sentenced to death. The trial court accepted the jurys recommendation and sentenced Woods to death by electrocution. The Court of Criminal Appeals affirmed his conviction and the sentence of death. Woods v. State, [Ms. CR-97-0027, Dec. 10, 1999] ___ So. 2d ___ (Ala. Crim. App. 1999). We granted Woodss petition for certiorari review.
